Terms of Service

These Terms of Service also serve as the End User License Agreement (EULA) governing your use of HourMark.

1. Description of Service and License Grant

HourMark is a pay tracking tool for 1099 independent contractors. It helps you log work hours, track payments, and generate worksheets for tax preparation. HourMark is not tax software and does not file tax forms on your behalf.

Subject to your compliance with these Terms, Nubric LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use HourMark on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use HourMark on any device that you do not own or control, and you may not distribute or make HourMark available over a network where it could be used by multiple devices at the same time.

You may not copy (except as expressly permitted by this license), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of HourMark, any updates, or any part thereof. Any attempt to do so is a violation of the rights of Nubric LLC and its licensors.

2. Account and Data

• You are responsible for the accuracy of data you enter into the App
• You are responsible for maintaining the security of your account credentials
• You may use the App without an account in local-only mode, in which case data is stored only on your device

3. Analytics and Feedback

• By using the App, you consent to the collection of anonymous usage analytics as described in our Privacy Policy
• Analytics data does not include personal information or any data you enter
• Feedback submitted through the App may be used to improve the App
• Feedback is associated with an anonymous user ID, not your personal identity

4. Subscriptions (HourMark Pro)

HourMark offers an optional paid subscription ("HourMark Pro") that unlocks additional features including unlimited contractors, CSV exports, and 1099 worksheet printing. The free tier of HourMark remains available without a subscription, limited to 2 active contractors and excluding export features.

Billing and Pricing

• HourMark Pro is available as a monthly ($3.99/month) or annual ($29.99/year) auto-renewing subscription. Prices may vary by region and are shown in your local currency at purchase.
• Payment will be charged to your Apple App Store account at the confirmation of purchase.
• Subscriptions automatically renew for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.

Managing and Cancelling Your Subscription

• You can manage, cancel, or turn off auto-renew at any time in your Apple ID account settings: Settings → [Your Name] → Subscriptions.
• Cancellation takes effect at the end of the current billing period; you retain Pro access through that date.
• Deleting the App does not automatically cancel your subscription.

Refunds

• All subscription payments are processed by Apple. Refund requests must be submitted to Apple at reportaproblem.apple.com.
• Nubric LLC does not process refunds directly and cannot reverse App Store charges.

Free Trials and Promotions

• If a free trial is offered, it will be disclosed at purchase. Unused portions of a free trial are forfeited when you purchase a subscription.
• Promotional pricing and introductory offers apply to new subscribers only unless stated otherwise.

Changes to Pricing or Features

• We may change subscription pricing or Pro features with notice. Price changes apply to subsequent renewal periods; you can cancel before renewal if you do not accept the new price.

Your use of HourMark Pro is also governed by Apple's Standard EULA for App Store apps, available at apple.com/legal/internet-services/itunes/dev/stdeula.

5. Tax Disclaimer

HourMark is a record-keeping tool only. It is not a substitute for professional tax advice, accounting services, or official IRS forms. The 1099-NEC worksheets generated by HourMark are for your reference only and are not official tax documents. You are solely responsible for your tax filings and compliance. We recommend consulting a qualified tax professional.

6. Intellectual Property

The App, including its code, design, and branding, is the property of Nubric LLC. You may not copy, modify, distribute, or reverse-engineer any part of the App.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by law, Nubric LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to:

• Loss of data
• Errors in tax calculations or reports
• Inaccurate record-keeping
• Reliance on App-generated worksheets for tax filing

9. Termination

You may stop using the App at any time. You may delete your account and all data from Settings. We reserve the right to suspend or terminate accounts that violate these Terms.

10. Changes to Terms

We may update these Terms from time to time. Changes will be reflected by the "Last Updated" date. Continued use of the App after changes constitutes acceptance.

11. Governing Law

These Terms shall be governed by the laws of the State of Arizona, without regard to conflict of law provisions.
