Terms of Service

1. The basics

• Moto Trax v1 is a read-only directory of US motocross tracks plus a monthly editorial News tab.
• There is no sign-in, no user account, no posting, no commenting, no claiming. You don't agree to anything by name — you just use the app.
• You must be at least 13 years old to use Moto Trax. (We rate the app 4+ but recommend a parent install it for younger riders.)

2. What Moto Trax is (and isn't)

Moto Trax is a directory of US motocross tracks with map and list views. Editorial content in the News tab is written by Nubric.

Moto Trax is not:

• A safety guarantee. Conditions, hours, gate fees, and open/closed status come from public sources or were correct when last updated. Always confirm with the track before you drive.
• An emergency service. If something happens at a track, call 911.
• An insurance product. Riding motocross is dangerous. We don't reduce that risk.

3. Track data

The track listings come from public sources:

• OpenStreetMap — sport=motocross features, used under the ODbL license with attribution.
• American Motorcyclist Association — public chartered-organization and event-search results filtered to motocross promoters.

Editorial content (the News tab) is original, written by Nubric.

If you spot wrong track info or want a track added/removed, email info@nubric.dev. We update via over-the-air content pushes — fixes typically reach all users on the next app launch after the push.

4. Acceptable use

You agree not to:

• Scrape or copy Moto Trax data in bulk without our written permission.
• Reverse engineer, decompile, or attempt to extract source code.
• Use automated tools (bots, scripts) to interact with the app, except for accessibility tools.
• Attempt to access content or systems we have not made public.

5. Service availability

We try to keep Moto Trax up. We don't guarantee uptime. If the app is down or data is stale, our maximum liability is to fix it.

6. Disclaimers

Moto Trax is provided "as is." Track contact information, AMA listings, and other directory data come from public sources or were correct as of last update. We don't verify this information ourselves. Always call ahead. We make no warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of liability

To the maximum extent allowed by law, Nubric is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Moto Trax. Our total liability for any claim is limited to $100.

8. Indemnification

You agree to indemnify and hold Nubric harmless against claims arising from your use of Moto Trax in violation of these terms.

9. Changes to these terms

If a future version of Moto Trax adds user accounts, posts, comments, or any other feature that changes the relationship between you and us in a material way, we will update these terms and notify users in-app before enabling those features. The "Last updated" date will change.

10. Governing law

These terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-laws rules. Disputes go to the state or federal courts in Maricopa County, Arizona.
