Terms of Service

1. The basics

• Sixty4 Racing is a companion app for the Sixty4 Racing speed-trap timer, plus a garage that tracks your 1:64 cars' speeds, lap times, and elapsed times.
• An account is optional. You can use the whole app without signing in; signing in only enables cloud backup of your garage.
• You must be at least 13 years old to use Sixty4 Racing. (We rate the app 4+ but recommend a parent set things up for younger racers.)

2. What Sixty4 Racing is (and isn't)

The app records the speed and timing of toy cars as measured by the Sixty4 timing hardware, and keeps a history per car. The displayed "scale speed" (measured speed × 64) and lap/elapsed times are a repeatable, toy-grade, novelty metric for fun.

Sixty4 Racing is not a calibrated or certified measuring instrument, and not a safety device. Numbers are estimates, affected by sensor placement, lighting, and your setup.

3. The hardware

Building and using a Sixty4 Racing timing unit involves electronics, lithium-polymer (LiPo) batteries, and 3D printing. You do so at your own risk. Follow the battery and component manufacturers' safety guidance. Nubric is not liable for any damage, injury, or loss arising from assembling, charging, modifying, or operating the hardware.

4. Your account

• Sign-in uses Sign in with Apple or Google. You're responsible for keeping access to that login secure; one account is for one person.
• Cloud backup/sync is provided "as is" and is not guaranteed. It is a convenience, not a guaranteed backup — keep your own records if your data matters to you.
• We may suspend or terminate an account that is used for abuse, fraud, or anything illegal.
• You can delete your account and its cloud data any time (Settings → Account → Delete account).

5. Car names & brands

The in-app car catalog is built from Wikidata (CC0 public-domain data) plus a curated list of brand-original casting names. Brand names and castings — including Hot Wheels®, Matchbox®, and Johnny Lightning® — are trademarks of their respective owners and are shown only to help you identify a car. Nubric and Sixty4 Racing are not affiliated with, sponsored by, or endorsed by those companies.

6. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the app's source code.
• Bulk-copy or scrape the bundled car catalog without our written permission.
• Use automated tools (bots, scripts) to interact with the app or our cloud, except for accessibility tools.

7. Service availability

We try to keep Sixty4 Racing and its cloud sync working and up to date via over-the-air updates. We don't guarantee uptime or that every update is bug-free. If something breaks, our maximum obligation is to fix it.

8. Disclaimers

Sixty4 Racing is provided "as is." Speeds, lap times, and elapsed times are estimates for entertainment. We make no warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of liability

To the maximum extent allowed by law, Nubric is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Sixty4 Racing, its cloud sync, or its hardware. Our total liability for any claim is limited to $100.

10. Indemnification

You agree to indemnify and hold Nubric harmless against claims arising from your use of Sixty4 Racing in violation of these terms.

11. Changes to these terms

If a future version materially changes the relationship between you and us, we will update these terms and notify users in-app before enabling those features. The "Last updated" date will change.

12. Governing law

These terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-laws rules. Disputes go to the state or federal courts in Maricopa County, Arizona.
